Article 3. Scope
3.1 These terms and conditions apply to every booking and stay at Kampeerboerderij de Zandkant.
3.2 The guest is responsible for ensuring that all additional guests and visitors comply with these terms and conditions and the house rules.
3.3 If the booking confirmation contains arrangements that differ from these terms and conditions, the arrangements in the confirmation take precedence.
3.4 These terms and conditions do not apply to the horse boarding facilities or purchases from the farm shop. Separate arrangements apply to those services.
Article 4. Bookings and formation of the agreement
4.1 You can book through our website, by email or by phone. The agreement is formed when we confirm your booking by email.
4.2 Check the confirmation as soon as you receive it. If any details are incorrect, let us know within 3 days.
4.3 We may refuse a booking without giving a reason, for example, for groups or if the stated availability is no longer correct. In that case, we will refund any amounts you have already paid in full.
4.4 The number of people staying in the accommodation must not exceed either the number stated in the booking or the maximum occupancy for the accommodation.
4.5 The agreement is personal to you. You may not sublet the accommodation or allow others to use it without our written consent.
Article 5. Prices
5.1 All prices are in euros and include VAT. When booking, you will see which charges are included in the price and which are additional, such as tourist tax, booking fees or extras.
5.2 Tourist tax is set by the municipality and charged per person per night.
5.3 If government taxes or levies (such as VAT or tourist tax) change after the agreement is formed, we may pass on the change. We will not pass on any other price increases after confirmation.
5.4 We are not bound by obvious errors or mistakes in prices, offers or information on the website.
Article 6. Payment
6.1 When booking, you pay a deposit of 30% of the total booking cost. You must pay the balance no later than 1 week before arrival. If you book within that period, you must pay the full amount immediately.
6.2 If you do not pay on time, we will send you a reminder and give you 14 days to pay. If you still do not pay, we may cancel the booking. In that case, the cancellation charges in Article 7 apply.
Article 7. Cancellation by the guest
7.1 A booking for a stay on a specific date falls under the exception in Article 6:230p(e) of the Dutch Civil Code. Therefore, the statutory 14-day right of withdrawal (cooling-off period) does not apply.
7.2 To cancel, you must notify us in writing by emailing info@zandkant.nl. The date we receive your email is the cancellation date.
7.3 If you cancel, the following cancellation charges apply:
up to 3 months before arrival: 15% of the total booking cost;
from 3 months to 2 months before arrival: 50% of the total booking cost;
from 2 months to 1 month before arrival: 75% of the total booking cost;
from 1 month before arrival until the day of arrival: 90% of the total booking cost;
on the day of arrival or later: 100% of the total booking cost.
7.4 If you arrive later or leave earlier than booked, the full booking cost remains payable.
7.5 We recommend taking out cancellation insurance.
7.6 If you want to change your booking, please contact us. We will accommodate changes where possible. A change to a shorter stay or cheaper accommodation counts as a partial cancellation.
Article 8. Cancellation or changes by us
8.1 If we cannot fulfil the agreement due to circumstances beyond our control, such as extreme weather, government measures, fire or an animal disease on the farm, we will let you know as soon as possible. We will offer you a comparable alternative or refund everything you have paid.
8.2 If we have to cancel for another reason, we will refund everything you have paid. We will compensate you for any further losses as required by law.
Article 9. Arrival and departure
9.1 Your arrival and departure times are stated in your booking confirmation.
9.2 On arrival, we may ask you to show valid identification. We are legally required to keep a guest register.
9.3 When you leave, you must leave the accommodation clean and tidy, in the same condition as when you arrived.
Article 10. Your stay and house rules
10.1 During your stay, you must follow the house rules and any instructions from us or our staff. You will receive the house rules on arrival or find them in the accommodation.
10.2 De Zandkant is a working farm with animals. Please respect the peace and quiet, stay out of stables and fields unless we tell you otherwise, and supervise children.
10.3 Pets are welcome on the campsite, but not in the holiday home or camping bungalow. Dogs must be kept on a lead throughout the property, and you must clean up after them immediately. A maximum of 2 pets is allowed per camping pitch.
10.4 Open fires are not permitted unless we give you permission. Always comply with any national or regional fire bans.
10.5 Quiet hours on the property are from 23.00 to 07.00.
10.6 Visitors are welcome if they register with us first. They must also follow the house rules. We may charge a fee for visitors.
Article 11. Termination due to disturbance
11.1 If the guest, an additional guest or a visitor fails to comply with these terms and conditions or the house rules despite a warning, or causes serious disturbance, we may terminate the agreement immediately. The people concerned must then leave the property immediately.
11.2 In cases of serious misconduct, such as violence, theft, drug use or animal abuse, we may do this without giving a warning first.
11.3 If the agreement is terminated under this article, you are not entitled to a refund of the total booking cost.
Article 12. Liability
12.1 You stay on our property, use the facilities and interact with the animals at your own risk. We are not liable for theft, loss of or damage to guests' belongings, unless the damage results from our intentional conduct or deliberate recklessness.
12.2 We are not liable for temporary disruptions or outages affecting facilities such as water, electricity or Wi-Fi that are not our fault, or for disturbance caused by weather conditions or normal farm operations.
12.3 If we are liable, our liability is limited to the amount paid out by our liability insurer in that case. If the insurer does not pay out, our liability is limited to the total booking cost. This limitation does not apply to personal injury or to our intentional conduct or deliberate recklessness.
12.4 The guest is liable for damage caused during the stay by the guest, additional guests, visitors or pets brought with them. Report any damage to us immediately.
Article 13. Complaints
13.1 If you have a complaint during your stay, tell us immediately so we can address it straight away.
13.2 If your complaint has not been resolved to your satisfaction, email us within 2 months of departure with a clear description of the complaint. We will provide a substantive response within 14 days.
13.3 If we cannot resolve the matter together, you may bring the dispute before the court with jurisdiction.
Article 14. Personal data
We use your personal data only to manage your booking and stay and to comply with legal obligations. Read more in our privacy policy.
Article 15. Governing law
15.1 All agreements with us are governed by Dutch law.
15.2 If any provision of these terms and conditions is invalid, the remaining provisions will remain in effect.
15.3 We may amend these terms and conditions. The terms and conditions in effect when you made your booking will always apply to that booking.
